Federal investigation into Charlie Kirk’s killing faces challenges
Federal investigators investigating the killing of conservative activist Charlie Kirk have found no connection between the accused gunman, 22-year-old Tyler Robinson, and the left-wing groups that former President Donald Trump’s administration vowed to target after the attack, three officials familiar with the case told NBC News.
“At this point, there is no evidence linking Robinson to any left-wing organizations,” an official close to the investigation said.
“Everything so far points to someone acting on their own, motivated by a dislike of Kirk’s ideology,” the person added.
Two sources noted that federal prosecutors may struggle to pursue charges against Robinson, while a third said authorities still expect some form of federal case to move forward.
Complicating matters, Robinson lived in Utah and did not cross state lines; The shooting occurred during an open campus debate at Utah Valley University. Furthermore, Kirk was neither a federal employee nor an elected official.
A Justice Department spokesman commented briefly: “The investigation is ongoing, and we will not be providing any further details.”
Robinson already faces state charges filed Tuesday, including aggravated murder and obstruction of justice. Utah prosecutors announced they will seek the death penalty, saying Robinson intentionally targeted Kirk, a co-founder of Turning Point USA, on Sept. 10 because of his “political expression.” His mother told investigators that Robinson had become more politically active and more left-leaning in the past year.
Thomas Brzozowski, who most recently served as the Justice Department’s domestic terrorism adviser, explained that Kirk’s murder could qualify as domestic terrorism, but finding a federal law to prosecute it could be difficult. There is no law in the U.S. that criminalizes domestic terrorism as a stand-alone offense, although prosecutors can seek higher sentences after a conviction.
The FBI often supports domestic terrorism cases that ultimately end up at the state level.
“As always, the FBI needs federal law to take the lead,” Brzozowski said. “Here, they appear to be assisting state authorities.”
Court documents also revealed text messages between Robinson and his roommate, whom police described as “a biological male and a suspect who was transitioning to a female.” Authorities have not released the roommate’s identity.
Acting Homeland Security Secretary Stephen Miller has vowed to take aggressive action. “We will use every tool in DOJ, Homeland Security, and government to identify, disrupt, and destroy these networks in Charlie’s name,” he declared.
But as NBC News reported Thursday, obstacles remain.
“There are very few federal laws in this area,” said Scott Walter, president of the Capital Research Center, a nonprofit organization in Washington that tracks progressive groups and has influence in conservative circles. “States and local governments need to play a much stronger role than they did in the 1960s. They have a lot more manpower.”
The Anti-Defamation League reports that since 2002, more than 70% of extremist attacks and domestic terrorist plots in the U.S. have stemmed from right-wing movements.
The 31-year-old conservative leader kicked off his “The American Comeback” tour at Utah Valley University, the first stop on a 10-campus circuit across the country. His mission, as always, was to challenge opponents and energize supporters in front of live audiences and millions of online viewers.
Wearing a white shirt that read “Freedom,” Kirk harnessed the energy of 3,000 supporters and skeptics, who entered the cheering crowd waving red and white “Make America Great Again” and “47” hats.
Audience Question Sparks Tense Conversation
About 20 minutes into the program, a young man in the audience came up to the microphone and asked a pointed question.
“Do you know how many mass shootings have been committed by transgender Americans in the last decade?” he asked.
“A lot,” Kirk replied with a quick remark. The audience responded with applause and cheers.
The man then claimed that the number was five. “Do you know how many mass shootings have been committed in America in the last ten years?” he continued.
Kirk leaned forward, picked up his microphone, and then sat back in his chair. “Do we include gang-related shootings or not?” he replied.

Without warning, a sharp “pop” echoed through the room.
Kirk staggered backward and to the left. Blood from his neck spattered onto his white shirt. The audience gasped, held their breath for a moment, and then screamed in horror.
